Asylum cases carry consequences that shape every part of a person’s life. At Circling Eagle Law, we help asylum seekers in Fargo, West Fargo, and surrounding communities navigate the U.S. asylum process with clear guidance and genuine personal attention. Founded by Lane C. Thompson on principles of integrity and transparency, our firm treats every case as the serious, individual matter it is.

We communicate in English, Cantonese, and Mandarin, with additional translation support available for other languages. Clients can reach us by phone, email, text, or video conference, so language and distance don’t have to be obstacles when you need legal help most.

A free 15-minute initial consultation is available to discuss your situation. Call us at (701) 401-7404 or reach out by phone, email, text, or video conference to take the first step.

Who May Qualify for Asylum

To qualify for asylum, you must demonstrate a well-founded fear of persecution based on one of five protected grounds: race, religion, nationality, membership in a particular social group, or political opinion. That fear can rest on persecution you’ve already experienced or a credible fear of future harm. Persecution can come from a government or from groups the government is unable or unwilling to control.

Spouses and unmarried children under 21 who are present in the United States can be included as derivative beneficiaries on the same application.

The one-year filing deadline is critical: applications must generally be filed within one year of arriving in the United States. Narrow exceptions exist for changed or extraordinary circumstances, but if you’re approaching or past that deadline, contact an asylum lawyer in Fargo right away.

Affirmative & Defensive Asylum in the Fargo Area

There are two pathways through the U.S. asylum system, and which one applies to you depends on whether you’re currently in removal proceedings.

Affirmative Asylum

If you’re not in removal proceedings, you file Form I-589 directly with USCIS and attend an interview with an asylum officer. Our team prepares you thoroughly for that interview, explains what documents to gather, and walks through submission timelines so nothing is missed. For clients in the Fargo area, we also prepare you for biometrics appointments at the USCIS Application Support Center in Fargo.

Defensive Asylum

If you’re in removal proceedings, asylum becomes a defense raised before an immigration judge. This pathway is more adversarial, and the stakes of each hearing are immediate. We keep you informed about local processing expectations and what each stage requires of you.

After Asylum Is Granted

Asylee status can open a path forward in the United States. You may apply for work authorization 150 days after filing a complete application, with authorization typically issued after 180 days. After one year of asylee status, you may apply for lawful permanent residence using Form I-485. We guide clients through these follow-on steps as their cases progress.
